Chapter III: Pay slip.

The provisions of this chapter apply to all persons employed or working in any capacity or in any place whatsoever for one or more employers and regardless of the amount and nature of their remuneration or the form or validity of their contract.

When wages are paid, the employer provides the persons mentioned in article L. 3243-1 with a supporting document known as a pay slip. The employer may not require any formality of signature or endorsement other than that establishing that the sum received corresponds to the net amount shown on the pay slip. Acceptance of a pay slip by an employee without protest or reservation does not constitute a waiver of payment of all or part of the salary and allowances or wage accessories due to the employee pursuant to the law, regulations, a collective labour agreement or contract. Nor can this acceptance constitute a settled account within the meaning of article 1269 of the Code of Civil Procedure.

The employer keeps a duplicate copy of employees’ payslips or payslips issued to employees in electronic form for a period of five years.

The retention of pay slips may be waived to take account of the use of other means, in particular computerised means, under the conditions set out in the second paragraph of Article L. 8113-6.
