Chapter V: Criminal provisions.

Any private-sector training provider that fails to appoint a statutory auditor in breach of the provisions of article L. 6352-8 is liable to a fine of €4,500.

Any private-sector training provider that has set up an economic interest grouping and fails to have its accounts audited by a statutory auditor, in breach of the provisions of article L. 6352-9, is liable to a fine of €4,500.

Any public-sector training provider who fails to keep a separate account for its continuing vocational training and apprenticeship activities, in breach of the provisions of article L. 6352-10, is liable to a fine of €4,500.

Any person who, in breach of the provisions of article L. 6352-11, carries out actions falling within the scope of continuing vocational training without sending the administrative authority a document showing how the sums received have been used and setting out the educational and financial results of its activity, the balance sheet, the profit and loss account and the notes for the last financial year for which the accounts have…

Failure to comply with the formalities prescribed by Article L. 6352-12 when advertising a declaration of activity is punishable by one year’s imprisonment and a fine of €4,500.

Failure to comply with article L. 6352-13 by means of advertising containing information that is likely to mislead as to the conditions of access to the courses on offer, their content, penalties or funding arrangements, is punishable by one year’s imprisonment and a fine of €4,500.

Failure by any training provider to conclude a contract with a natural person who undertakes training on an individual basis and at his own expense, in breach of the provisions of article L. 6353-3, is punishable by a fine of 4,500 euros.

Any training provider who draws up a contract that does not include the requirements set out in article L. 6353-4 is liable to a fine of 4,500 euros.

Any training provider who, before expiry of the withdrawal period provided for in article L. 6353-5, requires the trainee to pay sums in breach of the provisions of the first paragraph of article L. 6353-6 is liable to a fine of 4,500 euros. Failure to comply with the provisions of article L. 6353-7 will result in a fine of 4,500 euros being imposed on any trainee who is unable to attend the training course due to duly recognised force majeure.
