Chapter II: Definitions.

A homeworker is any person who : 1° Carries out work entrusted to them either directly or through an intermediary, on behalf of one or more establishments, in return for flat-rate remuneration; 2° Works either alone or with his or her spouse, partner in a civil solidarity pact, cohabitee or dependent children within the meaning ofarticle L. 313-3 of the Social Security Code, or with an auxiliary. Anyone who supplies all or part of the raw materials at the same time as the work, when these raw materials are sold to him by a client who then acquires the manufactured object or by a supplier indicated by the client and to whom the worker is obliged to go, retains the status of homeworker.

When home workers work in the same premises to perform complementary tasks, they acquire the status of workshop employees. These provisions do not apply when the homeworker works with his or her spouse, partner in a civil solidarity pact, cohabitee or with his or her children, under the conditions set out in 2° of Article L. 7412-1.
