Chapter VII: Tattooing products.

The person responsible for placing a tattoo product on the market is liable to a fifth-class fine: 1° Placing on the market, free of charge or against payment, a tattooing product whose composition does not comply with the decrees provided for in article R. 513-10-4 or without making available the information file mentioned in article R. 513-10-3 ; 2° Failing to make the information provided for in article R. 513-10-14…

Legal entities declared criminally liable, under the conditions set out inarticle 121-2 of the French Criminal Code, for the offences defined in article R. 5437-1 shall be liable, in addition to a fine in accordance with the terms and conditions set out inarticle 131-41 of the French Criminal Code, to the confiscation of the thing that was used or intended to be used to commit the offence.

Repeated offences under article R. 5437-1 are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

Placing on the market, whether free of charge or for a consideration, a tattoo product whose container or packaging does not bear one of the indications provided for in article R. 513-10-5 is punishable by the fine laid down for third class offences.
