Section 2: Rights and obligations attached to plant variety certificates

The plant variety certificate shall be declared null and void, by court decision, if it is established that: 1° Either it has been granted to a person who was not entitled to it, unless it is transferred to the person entitled to it; 2° Or that on the date on which it was granted the variety did not satisfy the conditions mentioned in Article L. 623-2.

The provisions of Articles L. 613-8 and L. 613-29 to L. 613-32 shall apply to applications for plant variety certificates and breeder’s certificates. The same applies to articles L. 613-9, L. 613-21 and L. 613-24, the body mentioned in Article L. 412-1 being substituted for the Institut national de la propriété industrielle.
