Section 4: Restoration proceedings

The restoration remedies provided for in articles L. 612-16 and L. 612-16-1 shall be submitted to the Director General of the Institute by the holder of the deposit, who must be the holder entered in the National Patent Register if the deposit is published, or his representative. A decision on the appeal for restoration shall be taken within six months of the date on which it was lodged. This period is interrupted, where applicable, by the notification provided for in Article R. 613-52, until the appeal is regularised or the objection is withdrawn.

Failing an express decision within the period referred to in Article R. 613-52-1, the appeal shall be deemed to have been accepted.
