Section 3: Consultation with the State

Projects for property transactions referred to in article L. 1311-10 must be preceded, prior to any amicable agreement, by a request for an opinion from the competent State authority when they are pursued by local authorities, their groupings and their public establishments. The provisions of the first paragraph do not apply to local public establishments approved to carry out credit transactions and to land consolidation associations and their unions.

These proposed property transactions include: 1° Leases, amicable agreements and agreements of any kind for the purpose of renting buildings of any kind for an annual rent, including charges, equal to or greater than an amount set by the competent administrative authority ; 2° Les acquisitions à l’amiable, par adjudication ou par exercice du droit de préemption, d’immeubles, de droits réels immobiliers, de fonds de commerce et de droits sociaux…

The persons mentioned in the first paragraph of article L. 1311-9 deliberate in the light of the opinion of the competent State authority.

The opinion of the competent State authority is deemed to have been given at the end of a period of one month from the date of referral to that authority.
