Section 5: Municipal liability in the event of accidents

Municipalities are liable for damages resulting from accidents suffered by mayors, deputy mayors and presidents of special delegations in the performance of their duties.

When the local elected representatives mentioned in articles L. 2123-31 and L. 2123-33 are the victims of an accident occurring in the course of their duties, the public authorities concerned shall pay directly to the practitioners, pharmacists, medical auxiliaries, suppliers and establishments the amount of the benefits relating to this accident calculated in accordance with the rates applied in respect of health insurance.

Municipalities are liable for damages suffered by municipal councillors and special delegates when they are the victims of accidents occurring either during municipal council meetings or meetings of commissions and boards of directors of municipal social action centres of which they are members, or during the performance of a special mandate.
