When a territorial councillor tenders his resignation, he sends it to the president of the territorial council, who immediately notifies the State representative.

Any member of the territorial council who, without a valid excuse, has refused to carry out one of the duties devolved upon him by the laws shall be declared to have resigned by the administrative judge. The refusal results either from an express declaration addressed to whom it may concern or made public by its author, or from persistent abstention after warning by the authority responsible for convening. Any territorial councillor absent from four consecutive meetings of the territorial council within a period of less than four months without a legitimate excuse accepted by the council shall be declared to have resigned automatically by the council at the next meeting.

When the functioning of the Territorial Council proves impossible, the Government may, on its own initiative or at the request of its President, pronounce its dissolution by a reasoned decree issued in the Council of Ministers.
