Section 1: Equalisation allowance

The share of the equalisation allowance provided for by the antepenultimate paragraph of article L. 3334-4 for the overseas departments, the collectivity of Saint-Martin and the territorial collectivity of Saint-Pierre-et-Miquelon is made up of a share of the urban equalisation allowance and a share of the minimum operating allowance, determined by applying to the total amount of each of these allowances the increased ratio defined in article L. 3443-1.

For the application of Article L. 3443-1, the total national population corresponds to the municipal population of all the départements, the collectivity of Saint-Martin and the territorial collectivity of Saint-Pierre-et-Miquelon, according to the latest population census.

The share of the urban equalisation grant for the overseas departments is distributed among them in proportion to their municipal population as determined by the most recent general census.

The minimum operating grant instituted by article L. 3334-7, after apportionment between metropolitan departments and overseas departments, organised by article R. 3334-3 is divided between the overseas departments that meet the conditions for allocation: 1° 80% on the basis of their population, as defined in article L. 3334-2; 2° 10% on the basis of the length of the road classified in the departmental public domain as assessed on 1st January…
