The benefit of training leave is by right to attend a training course or attend a training session meeting the criteria set out in article R. 4135-9. Any refusal by the employer must be justified and notified to the person concerned.

The organisation providing the training course or session must issue the employee with a certificate attesting to its actual attendance. This certificate shall be given to the employer if he requests it when he returns to work.
