Subsection 3: Right to an account

Persons with a single deposit account whose agreement is terminated by the credit institution holding the account are deemed not to have a deposit account, within the meaning of I of article L. 312-1, from the date of receipt of the termination decision.

For the purposes of III of article L. 312-1, silence on the part of a credit institution for a period of fifteen days from the date of the notice of receipt, or the applicant’s hand-delivery of an application to open an account, shall be deemed to constitute a refusal to open the account. For the application of the fourth paragraph of III of Article L. 312-1, the credit institution designated by the Banque de France shall notify the applicant, within three working days of receiving the designation decision, on paper or on another durable medium if the applicant expressly requests it, of a list of the documents required to open the account as well as the name and contact details of the branch…

In the absence of any response from the applicant to the notification sent pursuant to article R. 312-7, the designation of a credit institution by the Banque de France lapses within six months.

Any natural or legal person mentioned in I of article L. 312-1 who has opened a deposit account with an institution designated in accordance with the procedure defined in III of the same article may benefit from the banking services mentioned in article D. 312-5-1 without having to pay any contribution in return.

The Banque de France is informed as soon as possible by the credit institution of the reasons for refusing to open an account under the procedure provided for in III of Article L. 312-1 or of the reasons, on the basis of IV of the same article, for terminating the deposit account agreement.

The association or foundation acting in the name and on behalf of a natural person shall specify to the latter the documents required to exercise the right to an account with the Banque de France, as referred to in III of article L. 312-1.
