Section 3: Employers' group made up of private-sector members and local authorities.

With the aim of promoting the development of employment in a given area, private-sector entities may set up, with local authorities and their public establishments or with public establishments of the State, groups of employers in one of the forms mentioned in article L. 1253-2. The tasks entrusted to employees of the grouping who are made available to a local authority may not constitute the grouping’s main activity. The time devoted by each employee to tasks carried out on behalf of member local authorities may not exceed, over the calendar year, three quarters of the contractual or conventional working time or, failing that, the statutory working time, calculated annually.

Under the conditions set out in 8° of article 214 of the French General Tax Code, the grouping organises the guarantee of its debts to employees and to organisations that pay compulsory contributions.

Subject to the provisions of this section, the provisions of sections 1 and 2 apply to employers’ groups made up of private-sector members and local authorities.

A decree of the Conseil d’Etat shall determine the procedures for choosing the collective agreement applicable to the grouping and the conditions for informing the administrative authority of the creation of the grouping.
