Section 2: Management entrusted to a public institution in the absence of an agreement.

In the absence of the agreement provided for in the first paragraph of article L. 5427-1, a national public administrative establishment shall exercise the powers defined in the first paragraph of this article. The Board of Directors of the public body referred to in Article L. 5427-7 comprises an equal number of employee and employer representatives, appointed by the Minister for Employment on the recommendation of representative trade union organisations at national level. The Board of Directors elects its Chairman from among its members.

The conditions under which the body referred to in article L. 5427-1 is subject to inspection are determined by regulation.
