Section 5: Waste from infectious risk healthcare activities and similar waste

Failure by dispensing pharmacists or pharmacists managing an internal-use pharmacy providing on-lending of medicinal products to provide patients, free of charge, with packaging intended for the collection of waste from perforating medical devices under the conditions defined in article R. 1335-8-3 is punishable by a third-class fine.

I.-A fifth-class offence is punishable by a fine if a dispensing pharmacist fails to collect, free of charge, or charges a fee for the collection of waste defined in 3° of article R. 1335-8-1 that is brought to them by private individuals. II-Recidivism for the fifth-class offences provided for in this article is punishable in accordance with the provisions of articles 132-11 and 132-15 of the Criminal Code.
