Section 3: Exemptions

The exemptions referred to in the second paragraph of article L. 3335-4 are granted by the Préfet de département or, in Paris, by the Préfet de police or, in the département of Bouches-du-Rhône, by the Préfet de police des Bouches-du-Rhône.

The exemptions referred to in article L. 3335-4 are the subject of annual orders issued by the mayor of the municipality in which the public house whose temporary opening is requested is located. For each derogation requested, the application must specify the operating conditions of the public house, the desired opening hours and the categories of drinks concerned. These points are set out in the municipal authorisation order.

Any establishment mentioned in article D. 3335-16 which opens a public house without the mayor’s authorisation or without complying with the conditions set by the temporary dispensation is subject to the procedures set out in articles 4 and 5 of decree no. 93-1101 of 3 September 1993 concerning the declaration of establishments in which physical and sporting activities are practised and the safety of these activities.
