Establishing a public house at a fair, sale or celebration open to the public without having obtained authorisation from the municipal authorities is punishable by a 4th class fine.

Establishing a 3rd or 4th category on-trade premises without respecting the distances determined by prefectoral decree from existing premises in the same categories is punishable by a 5th class fine. A repeat offence under this article is punishable in accordance with article 132-11 of the Criminal Code.
