The coordinating doctor appointed by the sentence enforcement judge will summon the person subject to a treatment order to an interview, during which he will inform him of the procedures for implementing this measure and invite him to choose a treating doctor. In the event of disagreement between the father and mother, the family affairs judge chooses the minor’s attending physician in accordance with article 372-1-1 of the Civil Code.

The coordinating doctor informs the attending doctor designated under the conditions of article R. 3711-12 and obtains his consent to take charge of the person. The attending doctor confirms his agreement in writing to the coordinating doctor within fifteen days. If no response is received within this period, or if the response is negative, the coordinating doctor will invite the person to choose another attending doctor.

If no attending doctor can be chosen, the coordinating doctor will inform the sentence enforcement judge. In the case referred to in the fourth paragraph of article R. 3711-12, the sentence enforcement judge, in the presence of the coordinating doctor, will summon the person and, if applicable, those with parental authority over him, to try to reach an agreement on the choice of the attending doctor. In the case of a minor, if the holders of parental authority fail to act, the juvenile court judge, acting as a sentence enforcement judge, appoints the attending physician, under the same conditions as those set out in article R. 3711-15, after obtaining the minor’s opinion.

The provisions of this section are implemented, as far as possible, prior to the release of a convicted prisoner.
