Section 4: Conduct of the treatment order.

The relationship between the person and the attending physician is governed, subject to the provisions of this Title, by the code of medical ethics. The sentence enforcement judge may not intervene in the course of treatment decided by the attending physician.

During the course of the care order, the person may ask the coordinating doctor to change the attending doctor. The coordinating doctor informs the initially designated attending doctor. The provisions of articles R. 3711-12 to R. 3711-17 then apply.

During the course of the treatment order, the attending physician may decide to interrupt the person’s treatment. He then informs the coordinating doctor and the person without delay by registered letter with acknowledgement of receipt. The provisions of articles R. 3711-12 to R. 3711-17 then apply.

To ensure that the treatment order is complied with, the coordinating doctor meets with the person periodically, and at least once every three months, to assess their situation. At least once a year, the coordinating doctor will send the sentence enforcement judge a report containing all the information required to monitor compliance with the treatment order. Procedural documents sent to the attending physician in application of the provisions of article L. 3711-2 are given to him by the coordinating physician. When he ceases to follow the person, the attending physician returns these documents to the coordinating physician, who forwards them to the sentence enforcement judge.

Medical reports ordered by the sentence enforcement judge, either on the proposal of the attending physician or that of the coordinating physician, are governed by the Code of Criminal Procedure. A copy of these expert reports is sent to the coordinating doctor and, under the conditions set out in article R. 3711-22, to the attending doctor.

As stated in article R. 61-5 of the Code of Criminal Procedure, when the socio-judicial supervision accompanies a custodial sentence, the period during which the convicted person is on temporary leave, or is placed under the semi-liberty regime or is subject to external placement or placement under electronic surveillance does not count towards the duration of the socio-judicial supervision.

The provisions of articles R. 3711-18 to R. 3711-23 apply to the treating psychologist.
