Section 1: Disciplinary action

Disciplinary proceedings against a doctor, dental surgeon or midwife may only be brought before the Disciplinary Chamber of first instance by one of the following persons or authorities: 1° The national council or the departmental council of the professional body on whose roll the practitioner in question is registered on the date the matter is referred to the court, acting on their own initiative or following complaints, made in particular…

Disciplinary decisions taken by the hierarchical authority on the basis of statutory or contractual provisions against practitioners working in health establishments are forwarded by the director of the establishment to the director general of the regional health agency concerned.

The provisions of sections 1 and 3 to 7 of this chapter are applicable to Saint-Pierre-et-Miquelon under the conditions set out in Article R. 4112-6-1.
