Section 8: Conciliation

An attempt at conciliation is a compulsory prerequisite to referral to the Disciplinary Board of first instance, unless the complaint comes from one of the authorities mentioned in 1°, 2° or 3° of article R. 4234-1.

The president of the central or regional council will summon the author of the complaint and the accused pharmacist within one month of receiving the complaint, of which he will send a full copy, with a view to seeking conciliation. To this end, it appoints, from among the members of its Council, one to three advisors, known as conciliators, who are responsible for organising the conciliation of the parties.

During the conciliation meeting, the parties and, where applicable, their representatives are heard by the conciliator(s). A report of total or partial conciliation or a report of non-conciliation is drawn up, noting either the failure of the parties to come together or their absence from the conciliation meeting. In the event of non-conciliation or partial conciliation, the complaint, together with the minutes, is forwarded within three months of the date of receipt by the President of the relevant Central or Regional Council to the registry of the relevant Disciplinary Chamber of first instance, which deals with the complaint in accordance with the procedure set out in articles R. 4234-2 et seq.

If the regional or central council is responsible for failing to comply with the time limit referred to in article R. 4234-36, the author of the complaint may ask the president of the national council to refer the matter to the president of the competent disciplinary chamber of first instance. The President of the National Council shall forward the complaint within one month.

If the complaint concerns one of the members of the regional council, this council may ask the president of the national council to designate another regional council to organise the conciliation. If the complaint concerns one of the members of the Central Council, the Central Council may ask the President of the National Council to appoint one to three national ordinal councillors to organise the conciliation.
