The General Director of the Regional Health Agency’s choice of health establishment(s) to be responsible for providing on-call care is based on his assessment, in the light of the applicants’ responses, of their ability to meet the needs, obligations and criteria set out in 2°, 3° and 6° of article R. 6111-43.

Following the call for candidates mentioned in article R. 6111-42, the Director General of the Regional Health Agency shall designate one or more health establishments to be responsible for providing permanent care. This decision is taken after obtaining the opinion of the federations representing the health establishments on a collegiate basis.

Decisions to designate candidates are published in the Recueil des actes administratifs of the regional prefecture and on the website of the regional health agency. The decision to designate a candidate is notified to the selected health establishments by any means that can be relied upon to provide a date certain. The interested parties are also notified in the same way of the rejection of other applications.

The Director General may declare the call for candidates unsuccessful. In this case, he may designate one or more health establishments providing the public hospital service, in application of 2° of III of article L. 6112-2, to meet the needs for permanent care that remain uncovered.

The Director General of the Regional Health Agency shall keep an up-to-date list of the permanent care assignments provided by health establishments, persons mentioned in the first paragraph of I of Article L. 6112-2 or army hospitals. This list is published on the regional health agency website.

The participation of the establishments, the persons mentioned in the first paragraph of I of article L. 6112-2 and the army hospitals in round-the-clock care may be covered financially by the regional intervention fund mentioned in article L. 1435-8.
