Subsection 2: Procedure for compensation by substitution of the Office.

When, in application of article L. 1142-15, the Office is substituted for the insurer of the person responsible for the damage, the victim is compensated under the conditions set out in articles R. 1142-61 to R. 1142-63.

If the insurer has not made an offer of compensation by the end of the four-month period available to it, in accordance with article L. 1142-14, the victim or his heirs may submit a claim to the Office, by registered letter with acknowledgement of receipt, with a view to obtaining compensation from the insurer. When the person considered liable for the damage by the Commission for Conciliation and Compensation of Medical Accidents, Iatrogenic Diseases and Nosocomial Infections is not insured, the period provided for in article L. 1142-14 runs from the date of receipt by the Office of the opinion of this Commission.

When the insurance cover of the person liable for the damage has been exhausted or has expired, the insurer shall immediately notify, by registered letter with acknowledgement of receipt, the victim or his beneficiaries, the person considered to be liable, the Office and, if the damage falls within its scope, the fund set up under article L. 426-1 of the Insurance Code.
