Subsection 5: National Conciliation Commission.

In the cases provided for in article L. 6142-12, the ministers responsible for higher education and health shall take a decision in the light of the opinion issued by a national commission comprising : 1° Five university professors – hospital practitioners – biologists assigned to hospital and university centres; 2° Five biologists from university hospital centres. Substitute members belonging to the same categories are elected in equal numbers.

The members of the committee and their alternates are elected for four years by staff in the same category under the conditions defined by order of the ministers responsible for higher education and health.

The Commission is chaired alternately by one of the members mentioned in 1° and one of the members mentioned in 2° of article R. 6142-23, elected for one year by secret ballot by the members of the Commission. At the time of the initial election, the category from which the chairman is chosen is determined by drawing lots.

The matter is referred to the Commission by the Prefect, who chairs the Conciliation Commission provided for in Article L. 6142-11.

The committee examines the dossier sent by the prefect, which includes the opinion of the director of the training and research unit or, if there are several, the chairman of the medical education coordination committee and the opinion of the director(s) of the pharmacy training and research unit. A rapporteur is appointed for each case by the Chairman in office. The rapporteur does not have the right to vote when chosen from outside the committee. The Chairman convenes the Committee and draws up the agenda for the meeting. He shall include matters on the agenda either on his own initiative or at the request of the ministers responsible for higher education and health.

At their request, the committee may hear the director(s) of the training and research unit and the teacher in charge of the medicine department if the director is a pharmacist, or the teacher in charge of the pharmacy department if the director is a doctor, as well as the chairman of the board of directors, the director general and the chairman of the university hospital centre’s institutional medical committee, the…

The secretariat of the committee is provided by the departments of the Ministry of Higher Education and the Ministry of Health.

The committee’s opinion and the minutes of the meeting are forwarded to the ministers responsible for higher education and health for their decision. The ministers shall decide without the committee’s opinion if the committee is unable to deliberate validly due to the absence of the majority of its members.
