Paragraph 4: Secondment.

Practitioners covered by these Staff Regulations may be seconded either at their own request or automatically. The secondment on request or its renewal is granted by the Director General of the National Management Centre, after obtaining the opinion of the head of the department, the head of the service, the chairman of the establishment’s medical committee and the director of the establishment in which the person concerned is working for the initial request and its first renewal. These opinions are not required for subsequent renewals.

A practitioner called upon to perform the duties of a member of the government or a parliamentary mandate is automatically seconded for the duration of these duties or mandate. A practitioner seconded to a post as general advisor to health establishments is seconded automatically for the duration of the contract. Subject to the provisions of article R. 6152-53, compulsory secondment may only be granted when the interests of the service so require, to a post of hospital practitioner in the same discipline and with equivalent remuneration, in one of the establishments mentioned in article R. 6152-1. In the cases provided for in 2°, 4°, 6° and 8° of article R. 6152-51, the practitioner may not obtain a secondment before three years of service in his post. Only hospital practitioners appointed on a permanent basis may benefit from the secondment provided for in 5° of the aforementioned article. The request for secondment must be submitted by the practitioner at least two months in advance.

Practitioners on secondment continue to benefit from their right to promotion in their original body. He shall cease to receive any remuneration in respect of the body from which he is seconded.

The secondment is granted for a maximum period of five years and may be renewed under the same conditions. When the period of secondment exceeds six months, the post is declared vacant, except in the case provided for in 3° of article R. 6152-51, for which the post is declared vacant when this period exceeds one year.

On expiry of his secondment, the practitioner is reinstated : 1° Either, by right, to his post if the period of secondment has not exceeded six months or one year if the practitioner was seconded pursuant to 3° of article R. 6152-51 ; 2° Or to his post if it is still vacant, by decision of the Director General of the Centre National de Gestion after receiving a favourable opinion…
