The exercise of a lucrative private activity outside the establishment under the conditions defined by article L. 6152-4 and by article L. 6152-5-1 must not jeopardise the smooth running of the service or interfere with the fulfilment of the missions defined in articles L. 6111-1 to L. 6111-1-4 and L. 6112-1.

Any hospital practitioner intending to carry out a private for-profit activity outside the establishment must inform the director of the establishment in which he/she is principally employed in writing at least two months before the commencement of this activity and provide documentary evidence of the place where this activity is to be carried out and the type of work involved.

When the director of the establishment makes his decision subject to a ban on the practitioner carrying out a lucrative private activity within a maximum radius of ten kilometres of the public health establishment in which he is mainly practising, in application of II of article L. 6152-5-1, this decision is taken after consulting the establishment’s medical committee.

When the director of the establishment establishes that the prohibition provided for in II of article L. 6152-5-1 has not been complied with, a summons is sent to the practitioner’s practice address at least fifteen days before the date of the interview by any means giving a date certain.
