Subsection 3: Operation

The Conseil national de l’inspection du travail (National Labour Inspection Council) draws up internal regulations approved by order of the ministers concerned. These rules set out the procedures for the adversarial examination of cases submitted to the Council.

The members of the National Labour Inspection Council carry out their duties in compliance with the requirements of independence, impartiality and integrity. They are bound by the secrecy of the body’s debates and may not intervene in any other capacity during the investigation of a case referred to the Council pursuant to Article D. 8121-2. The National Labour Inspection Council elects its Chairman from among its members at each triennial renewal. If the Chairman is unable to complete his term of office, resigns or for any other reason, his replacement is appointed under the same conditions for the remainder of the term.

The secretariat of the National Labour Inspection Council is provided by the Director General of Labour or his representative.

The duties of member of the National Labour Inspection Council are not remunerated. Travel expenses are reimbursed in accordance with decree no. 2006-781 of 3 July 2006 setting the terms and conditions for the payment of expenses incurred by the temporary travel of civil servants of the French State.
