Subsection 2: Setting up and running skills operators

The Skills Operator’s Board of Directors is made up of an equal number of employee and employer representatives appointed by the signatory organisations. Members of the Board of Directors may be represented by an alternate appointed in the same way as the full member. The composition of the Board of Directors takes into account the diversity of the member professional branches.

Skills operators may enter into an agreement with a legal entity to delegate the implementation of some of the decisions relating to the information and services mentioned in 1°, 2°, 3° and 5° of II of article R. 6332-17. This legal entity may not be a training provider, a training body manager, an employers’ organisation or an employees’ organisation. The management tasks of a skills operator may not be entrusted directly or indirectly to a training provider organisation mentioned in article L. 6351-1 or to a credit institution. However, tasks relating to the management of the personal training account may be entrusted to the Caisse des dépôts et consignations.

I.-A salaried position within a skills operator is incompatible with holding a salaried position in a training provider organisation mentioned in article L. 6351-1, a credit institution or a finance company. The assets of skills operators that cease their activity are devolved to organisations of the same nature, designated by the Board of Directors. This devolution is subject to the prior agreement of the Minister responsible for vocational training. The decision is published in the Journal officiel de la République française. Failing this, the assets are transferred to the Treasury.

Skills operators may not own any assets other than those necessary for their operation.
