Subsection 4: Breach of contract

Early termination of the apprenticeship contract or the apprenticeship period is the subject of a written document, in accordance with the conditions laid down in articles L. 6222-18 to L. 6222-19. The director of the apprentice training centre and the body responsible for registering the contract are notified.

Within a period that may not be less than five calendar days from the date of referral to the mediator as provided for in article L. 6222-18, the apprentice shall inform the employer of his intention to terminate the contract by any means that provides a date certain. An apprentice who wishes to terminate his contract if he obtains the diploma or qualification being prepared for, in application of article L. 6222-19, must inform the employer in writing at least one month before the end of the contract.

In order to allow a new apprenticeship contract to be signed in application of article L. 6222-18-2, an exception may be made to the minimum duration of the apprenticeship contract mentioned in the first paragraph of article L. 6222-7-1 and to the minimum duration of training in an apprentice training centre mentioned in the fifth paragraph of article L. 6211-2.
