Chapter VII: Criminal provisions

Failure by an employer to comply with the provisions of articles L. 6222-1, L. 6222-2, L. 6222-11, L. 6222-24, L. 6223-2 to L. 6223-8, R. 6223-9, R. 6223-22 and R. 6223-23 is punishable by a fourth-class fine.

Employing an apprentice for work in excess of eight hours per day or the legal weekly working hours set by article L. 3121-27 of the French Labour Code and article L. 713-2 of the French Rural and Maritime Fishing Code, in breach of the provisions of article L. 6222-25, is punishable by a fourth-class fine.

Employing an apprentice under the age of eighteen to work at night, in breach of the provisions of article L. 6222-26, is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

Paying an apprentice less than the minimum wage stipulated in article L. 6222-27 is punishable by a fifth-class fine. The fine is applied as many times as there are apprentices paid under illegal conditions. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the Criminal Code.

Employing an apprentice in work that is dangerous to their health or safety, in breach of the provisions of article L. 6222-30, is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the Criminal Code.

Failure to present the apprentice for the tests for the diploma or qualification provided for in the apprenticeship contract, in breach of the provisions of article L. 6222-34, is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the Criminal Code.

Failure to grant an apprentice an additional five days’ leave to prepare for tests at an apprentice training centre, or failure to maintain the apprentice’s salary during this leave in breach of the provisions of article L. 6222-35, is punishable by a fine for a fifth-class offence. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the Criminal Code.

Failure by an employer to comply with the provisions of article L. 6223-1 is punishable by a fifth-class fine.

Failure by an employer to comply with the provisions of article L. 6225-1 is punishable by a fifth-class fine.
