Chapter IV: Submission of the contract

On receipt of the contract, the Skills Operator decides whether or not it will be funded. To this end, it checks that the contract meets the conditions laid down by : 1° Article L. 6211-1 relating to courses eligible for apprenticeship; 2° Articles L. 6222-1 to L. 6222-3 relating to the age of the apprentice; 3° The first paragraph of article L. 6223-8-1 relating to the apprenticeship master; 4° Article…

The Skills Operator shall take a decision on the financial contribution within twenty days of receipt of all the documents mentioned in article D. 6224-1. If it remains silent after this period, an implicit decision will be taken refusing to cover the costs.

The skills operator submits the contract, by electronic means, to the services of the minister responsible for vocational training. Where appropriate, it will simultaneously inform these departments of its refusal to cover the cost, and of the reasons for this refusal.

Any change to an essential element of the contract is the subject of an amendment sent to the skills operator for filing under the conditions set out in this chapter. On receipt of the amendment, the skills operator will decide either whether to cover the cost, if it had initially refused to do so, or whether to continue to cover the cost.

When the apprenticeship contract is terminated before its term, the employer immediately notifies the termination to the skills operator, who informs the services of the minister responsible for vocational training. The notification may be made by electronic means.

There is no charge for filing an apprenticeship contract.

When a minor apprentice is employed by an ascendant, the declaration provided for in article L. 6222-5, signed by the ascendant employer, is signed by the apprentice and stamped by the director of the apprentice training centre. It is sent to the skills operator and is subject to the filing procedure under the conditions laid down in this chapter.
