Chapter V: Infringements of the rules on occupational medicine

Failure to comply with the provisions relating to the tasks and organisation of occupational health services, as set out in articles L. 4622-1 to L. 4622-17 and the decrees implementing them, is punishable by a fifth-class fine.

Failure to comply with the provisions relating to recruitment, conditions of practice, protection and professional independence enjoyed by occupational health doctors, as set out in articles L. 4623-1 to L. 4623-8 and L. 1237-15 and the decrees issued for their application, is punishable by a fifth-class fine.

Failure to comply with the provisions relating to the action of the occupational physician, set out in article L. 4624-1 and those of the decrees adopted for their application, is punishable by a fifth-class fine.

Failure by an employer or his representative to organise occupational health and safety services in an establishment with a workforce of two hundred and fifty or more, in breach of article L. 4631-1, is punishable by a fourth-class fine.

Failure to comply with the provisions relating to medical surveillance of specific categories of workers set out in articles L. 4625-1 and L. 4625-2 and the decrees implementing them is punishable by a fifth-class fine.

Failure to comply with the provisions relating to company nursing staff set out in articles R. 4623-32 to R. 4623-33 or, in the case of the agricultural professions,article R. 717-53 of the Rural and Maritime Fishing Code, is punishable by a fifth-class fine.
