Chapter III: Infringements of the rules concerning work by young people and by pregnant women, women who have recently given birth or who are breastfeeding

Employing a pregnant woman, a woman who has recently given birth or a nursing mother in prohibited work, in disregard of article L. 4152-1 and the decrees adopted for its application, is punishable by a fine of the fifth class. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

Failure to comply with the provisions of articles R. 4152-13 to R. 4152-28 relating to breastfeeding rooms is punishable by a fifth-class fine, imposed as many times as there are workers concerned by the offence. Employing a worker under the age of eighteen in prohibited work, in disregard of article L. 4153-8 and the decrees adopted for its application, is punishable by a fine of the fifth class. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

Employing a worker under the age of eighteen on the work referred to in article L. 4153-9 in breach of the conditions set out in that article and in the decrees issued for its application is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

Failure to comply with the provisions relating to the age of admission set out in articles L. 4153-1 to L. 4153-5 and the decrees implementing them is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.

The fine provided for in article R. 4743-5 is applied as many times as there are persons employed under conditions contrary to the requirements mentioned in the same article. In the event of more than one offence resulting in a repeat offence, the fine will be applied as many times as new offences are discovered.

Any operator of an on-trade public house who, without having obtained the authorisation provided for in article R. 4153-8, employs or provides training for minors, with the exception of the owner’s spouse or parents or relatives up to and including the fourth degree, is liable to a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the Criminal Code.
