Section 3: Work equipment and means of protection.

The labour inspection officer referred to in Article L. 8112-1 may ask the employer to have the conformity of the work equipment referred to in Article L. 4321-1 with the provisions applicable to it verified by an accredited body. It shall set the time limit within which this body must be contacted.

The labour inspection officer referred to in Article L. 8112-1 may request that an accredited body verify the conformity of second-hand work equipment and means of protection subject to the conformity certification procedure provided for in Article R. 4313-14 and which are the subject of one of the operations referred to in Article L. 4311-3, with the technical provisions applicable to them.

The employer or the person responsible for the operation referred to in Article L. 4311-3 shall provide proof that he has referred the matter to the accredited body within the time limit set and shall forward the results of the checks on the conformity of the work equipment to the Labour Inspectorate as soon as they are received.

A copy of the accredited body’s report is simultaneously sent by the employer to the prevention department of the relevant social security body.
