Section 2: User company health, safety and working conditions committee.

The social and economic committee of the user undertaking shall, if it considers it necessary, instruct one or more of its members belonging to the staff delegation to take part in inspections and periodic coordination meetings. These members issue an opinion on the prevention measures. This opinion is included in the prevention plan if the plan has to be drawn up in writing.

Where there may be risks associated with interference between the activities, installations and equipment of different companies, the social and economic committee of the user company shall, as part of its duties, carry out the inspections and surveys provided for in articles L. 4612-4 and L. 4612-5, in workplaces temporarily occupied by workers from external companies.

Representatives of external companies on the user undertaking’s social and economic committee, enlarged in application of article L. 4523-11, are not considered as belonging to the staff delegation of the user undertaking’s social and economic committee.
