Chapter VII: Administrative declaration

The first use of biological pathogens must be declared to the Labour Inspectorate at least thirty days before the work begins.

The declaration of the first use of biological pathogens must include : 1° The name and registered office of the company and the address of the establishment; 2° The name and address of the occupational physician; 3° The name and position of the safety officer, if any, in the workplace; 4° The result of the assessment of the risks of exposure to biological agents; 5° The species or, failing that,…

A declaration of first use is also sent to the labour inspection officer, at least thirty days before their first use, for biological agents not yet classified within the meaning of article R. 4421-4, where there is a presumption that they are pathogenic.

The declaration of first use is not compulsory for laboratories carrying out medical biology analyses. They are only required to declare their intention to provide a diagnostic service for group 4 biological agents.

The declaration of first use is renewed whenever a significant change in processes or procedures renders it obsolete.
