Chapter III: Risk assessment

For any activity likely to present a risk of exposure to biological agents, the employer shall determine the nature, duration and conditions of exposure of workers. For activities involving exposure to biological agents belonging to several groups, the risks are assessed taking into account the danger presented by all the biological agents present or likely to be present as a result of this activity.

The risk assessment is carried out on the basis of the classification provided for in article R. 4421-3 and the occupational diseases caused by exposure to biological agents. When assessing risks, the employer shall pay particular attention to the hazards of biological agents likely to be present in the bodies of patients or deceased persons and in living or dead animals, in samples, specimens and waste arising therefrom.

The employer shall make the information used to assess the risks available to the Labour Inspectorate and to the agents of the prevention department of the social security bodies.
