Paragraph 1: Control of occupational exposure limit values

For the application of 3° of Article R. 4412-12, the employer shall regularly measure the exposure of workers to hazardous chemical agents present in the workplace atmosphere. When occupational exposure limit values have been established for a hazardous chemical agent in application of Articles R. 4412-149 or R. 4412-150, the employer shall have technical inspections carried out by a body accredited under the conditions laid down in Articles R. 4724-8…

If an occupational exposure limit value set in Article R. 4412-149 or a concentration set in Article R. 4222-10 is exceeded, the employer shall immediately take the appropriate preventive and protective measures to ensure the protection of workers.

If an indicative occupational exposure limit value provided for in Article R. 4412-150 is exceeded, the employer shall carry out a risk assessment in order to determine appropriate prevention and protection measures.

The results of the measurements and the technical inspection reports are communicated by the employer to the occupational physician and to the social and economic committee. They are kept at the disposal of the Labour Inspectorate control officer, the Labour Inspectorate control officer doctor and the agents of the prevention services of the social security organisations.

Measurements and technical checks carried out in application of this paragraph must comply with the procedures and methods laid down in application of Article R. 4412-151.
