Article R4227-55 of the French Labour Code

The Regional Director for Business, Competition, Consumer Affairs, Labour and Employment may grant an establishment a temporary or permanent exemption from some of the requirements laid down in this chapter, on the basis of a proposal for compensatory measures ensuring a level of safety deemed equivalent, when it is recognised that it is practically impossible to apply one of these requirements.

Article R4227-56 of the French Labour Code

Exemption is granted after investigation by the Labour Inspectorate. It is granted after obtaining the opinion of: 1° The social and economic committee; 2° The departmental consultative committee on safety and accessibility for establishments open to the public.

A decision by the Regional Director of Business, Competition, Consumer Affairs, Labour and Employment will be deemed to have been rejected if the competent Minister to whom the matter is referred remains silent for more than four months in the event of a hierarchical appeal.
