Subsection 3: Reimbursement by the State.

An employee who receives substitute remuneration during the period for which he/she is entitled to the minimum monthly remuneration, in breach of the obligation provided for in article R. 3423-5, shall repay the monthly aid paid by the State in respect of this minimum monthly remuneration. A repayment order is issued by the Prefect and recovered by the Departmental or, where applicable, Regional Director of Public Finances.

Automated processing of nominative information relating to employees receiving minimum monthly remuneration may be created. This information is intended to enable the control officers mentioned in article L. 8271-7 to ensure the application of the procedure for the restitution of sums wrongly received, as provided for in article R. 3423-6.
