Individuals, companies or organisations that only provide home delivery services are not eligible for the same treatment as restaurant owners.

When the file submitted by the applicant for assimilation to the profession of restaurateur is complete and it is shown that the person concerned meets the conditions laid down in article R. 3262-27 for assimilation, the Commission will send him/her a certificate by registered letter with acknowledgement of receipt. On receipt of this certificate, assimilation is deemed to have been granted.

If the application is not complete, the Commission will send the applicant for assimilation a registered letter with acknowledgement of receipt, specifying the missing supporting documents to be produced within one month of receipt of the registered letter. If, within one month of the date of receipt of the application as shown on the notice of receipt, the Commission has not sent the applicant for assimilation an attestation that the application is complete or requested the production of any missing supporting documents, assimilation is deemed to have been granted.
