Sub-paragraph 1: Exemptions granted by the Prefect

The extension authorisations referred to in Article L. 3132-23 are granted in accordance with the procedures set out in the first paragraph of Article L. 3132-21. The opinions mentioned in the first paragraph of article L. 3132-21 are given within one month. The Prefect then takes a decision within eight days by means of a reasoned decision which he immediately notifies to the applicants.

The extension authorisations provided for in Article L. 3132-23 apply to establishments located in the same locality, carrying on the same activity and serving the same clientele. The extension authorisations provided for in Article L. 3132-23 are granted on the basis of a collective agreement applicable to the establishment concerned by the extension or, failing this, a unilateral decision by the employer approved by referendum.

The regional prefect shall delimit the zones mentioned in articles L. 3132-25 and L. 3132-25-1 by decree. When a zone is located in the territory of more than one region, the regional prefects concerned delimit it by joint decree.

In order to be included on the list of tourist areas referred to in article L. 3132-25, the areas must receive a significant additional population during certain periods of the year due to their natural, artistic, cultural or historical features or the existence of leisure or spa facilities with high visitor numbers.
