Subsection 2: Composition of committees

The National Conciliation Commission is made up of: 1° The Minister for Labour or his/her representative, as Chairman; 2° A representative of the Minister for the Economy; 3° Five employers’ representatives; 4° Five employees’ representatives.

The Regional Conciliation Commission comprises a regional section and, where applicable, sections with departmental or interdepartmental jurisdiction. The regional and interdepartmental sections comprise: 1° The regional or departmental prefect or his representative, as chairman; 2° Five employers’ representatives; 3° Five employees’ representatives.

The departmental section comprises: 1° The prefect or his representative, as chairman; 2° Five employers’ representatives; 3° Five employees’ representatives.

When the dispute concerns a branch of activity for which the departments of the ministers responsible for industry, public works and transport exercise, pursuant to a legislative provision, the functions normally devolved to the labour inspectorate, the committees or sections provided for in articles R. 2522-8 to R. 2522-10 also include a representative of the administration concerned. The members of the conciliation boards are appointed for three years.

The members of the National Commission are appointed by order of the Minister of Labour. The members of the regional sections and those of the sections with interdepartmental jurisdiction are appointed by order of the regional prefect. The members of the departmental sections are appointed by order of the prefect.

Employers’ and employees’ representatives on the committees and sections are appointed on the proposal of nationally representative employers’ and employees’ trade unions. These organisations submit to the appointing authority lists containing twice as many names as there are posts to be filled. Before making the appointments, the Prefect will seek the opinion of the Regional or Departmental Director of Labour, Employment and Vocational Training.

Twice as many alternate members are appointed under the same conditions as the full members. They sit only in the absence of the full members. The full and alternate representatives of employers and employees within the regional, interdepartmental and departmental sections are chosen from among employers and employees who actually carry on their professional activity within the jurisdiction of these sections.

Committee members must not have been disqualified, disqualified or disqualified from holding public office.
