Section 6: Temporary work

Seconded employees made available to a user undertaking established in France benefit from the stipulations of the agreements and arrangements applicable to the workplace and to the employees employed by this user undertaking in the matters mentioned in article L. 1251-21, and with regard to remuneration in accordance with article L. 1251-18.

For the application of the financial guarantee obligation set out in articles L. 1251-49 and L. 1251-50, paragraphs 2 and 3 to L. 1251-53 to temporary employment undertakings which post an employee to France, the guarantee ensures payment to posted employees, throughout the period of their work on French territory, of wages and related benefits, as well as allowances resulting from chapter one of title V.

Guarantees taken out in their country of origin by companies established in a Member State of the European Union, a party to the Agreement on the European Economic Area or in the Swiss Confederation may be regarded as equivalent to the financial guarantee provided for in article R. 1262-17 if they provide the same protection for the employees concerned.
