Subsection 4: Rights of persons detained in socio-medico-judicial security centres

The rights of persons held in a socio-medico-judicial security centre, and the restrictions to which they may be subject, are determined by the provisions of articles R. 541-11, R. 541-12 and R. 541-13 of the penitentiary code.

The sentence enforcement judge may grant a detainee escorted leave, particularly in the event of a serious family event.

The sentence enforcement judge may grant the detainee permission to leave under mobile electronic surveillance for one or more days in order to maintain family ties or to prepare for the end of the detention period.

Permission to leave the prison is granted or refused by reasoned order, after consulting the director of prison services, the director of the public health establishment and the public prosecutor. The public prosecutor or the detainee may appeal against these orders to the president of the regional security detention court within five days of notification. The Director of Penitentiary Services shall take any measures necessary for the good order of the centre, the safety of individuals and the security of property under the conditions laid down by the provisions of Articles R. 541-15 and R. 541-16 of the Penitentiary Code.

The president of the regional court for secure detention, on referral from the sentence enforcement judge, may issue a search order against a detainee: 1° Who evades the detention measure to which he or she is subject; 2° Who does not return to the centre after being granted leave.
