Subsection 1: General duties of masseur-physiotherapists

The provisions of this Code of Ethics apply to masseur-physiotherapists registered with the Association and to masseur-physiotherapists practising a professional act under the conditions set out in articles L. 4321-1, L. 4321-2 and L. 4321-4. In accordance with article L. 4321-14, the order of masseur-physiotherapists is responsible for ensuring compliance with these provisions. Infringements of these provisions are subject to the Order’s disciplinary jurisdiction.

The provisions of sub-sections 1 and 2 of this code also apply to the physiotherapy students mentioned in article L. 4321-3. Infringements of these provisions are the responsibility of the disciplinary bodies of the training establishments and organisations in which these students are registered.

The masseur-physiotherapist, in the service of the individual and public health, carries out his mission with respect for human life, the individual and his dignity. The respect due to the individual does not cease to apply after death.

The masseur-physiotherapist respects, in all circumstances, the principles of morality, probity and responsibility essential to the practice of physiotherapy.

The professional secrecy instituted in the interest of patients is binding on the masseur-physiotherapist and the physiotherapy student under the conditions established by articles L. 1110-4 and L. 4323-3 respectively. Secrecy covers everything that comes to the knowledge of the masseur-physiotherapist in the exercise of his profession, i.e. not only what has been entrusted to him, but also what he has seen, heard or understood.

The masseur-physiotherapist may not alienate his professional independence in any form whatsoever.

The masseur-physiotherapist respects the right of all persons to freely choose their masseur-physiotherapist. He facilitates the exercise of this right.

The masseur-physiotherapist must listen to, examine, advise and care for all persons with the same conscience, whatever their origin, morals and family situation, their real or supposed membership or non-membership of a particular ethnic group, nation or religion, their disability or state of health, their social cover, their reputation or the feelings he or she may have towards them. Within the limits set by the law, the masseur-physiotherapist is free to take whatever action he considers most appropriate in the circumstances. Without neglecting his duty of moral support, he limits his actions to what is necessary for the quality, safety and effectiveness of the care. A masseur-physiotherapist who is in the presence of a sick or injured person who is in danger, or who is informed that a sick or injured person is in danger, provides assistance or ensures that he/she receives the necessary care.
