Paragraph 1: Machinery and personal protective equipment

The manufacturer, importer or any other person responsible for placing on the market a new or considered new example of machinery or personal protective equipment subject to the technical rules of Annexes I or II respectively shall draw up and sign an EC declaration of conformity stating that the machinery or personal protective equipment complies with the relevant technical rules of the relevant Annex and has undergone the applicable conformity…

The EC declaration of conformity is given to the customer when a machine is sold, hired out, transferred or made available for any purpose whatsoever.

A conformity marking, consisting of the CE mark, is affixed visibly, legibly and indelibly to each item of machinery and to each item of personal protective equipment.

Where, due to the characteristics of the personal protective equipment, it is not possible to affix the CE marking on the copies, it will appear on the packaging.

The CE marking shall be affixed by the manufacturer, importer or any other person responsible for placing the machinery or personal protective equipment on the market, certifying that it conforms to the relevant technical rules set out in the Annex at the end of this Title and has undergone the applicable conformity assessment procedures.

The display, offering for sale, sale, hire, import, transfer or making available for any purpose whatsoever of new machinery or personal protective equipment or equipment considered to be new subject to a conformity assessment procedure is subject to the compilation by the manufacturer, importer or any other person responsible for placing it on the market of a technical file relating to the means implemented to ensure conformity with the applicable…
