The decision appointing the compliance officer(s) or the members of the college that make up the compliance officer(s) shall specify the term of office, the procedures for referring matters to him/her and for examining them, as well as the conditions under which opinions are issued. When the deliberation referred to in article R. 1111-1-B provides for the persons exercising these functions to receive compensation, this compensation shall take the form of holiday allowances, the amount of which may not exceed a ceiling set by order of the Minister responsible for local authorities. It may also provide for the reimbursement of their travel and accommodation expenses under the conditions applicable to local civil service staff.

The ethics officer(s) or the members of the college constituting it are bound by professional secrecy in compliance with articles 226-13 and 226-14 of the French Criminal Code and to professional discretion in respect of all facts, information or documents of which they become aware in the course of or in connection with the performance of their duties.
