Title IV: The interprofessional ambulatory care company

The activities referred to in 2° of Article L. 4041-2 are defined as follows: 1° Therapeutic coordination, understood as the procedures put in place within the company or between the company and its partners, aimed at improving the quality of care and the coherence of the care pathway; 2° Therapeutic patient education as defined in Article L. 1161-1 ; 3° Cooperation between healthcare professionals as defined in Article L. 4011-1.

The Articles of Association do not contain any provision that seeks to obtain a minimum return from a partner or that is likely to affect the professional independence of each partner and the patient’s free choice of practitioner.

In maisons de santé set up as interprofessional outpatient care companies, the health project referred to in article L. 6323-3 is appended to the articles of association.

I.-A company wishing to employ a healthcare professional must first apply for registration on the roll of the professional concerned. II.-Applications for registration must be made by a joint representative appointed by the partners in the company’s articles of association or by a separate instrument. The representative referred to in II of article R. 4041-7 shall send the application for registration to the council of the professional body with territorial jurisdiction by any means, including electronic means, that provide a date certain of receipt. The application must include: 1° A copy of the company’s articles of association and appendices; 2° A copy of the company’s Kbis extract.

I.-The competent local Bar Council will check that the articles of association and appendices of the interprofessional ambulatory care company comply with the legislative and regulatory provisions in force. II.-The decision will be notified to: 1° The authorised representative; 2° To the Director General of the Regional Health Agency and to the health insurance bodies of the general scheme and the mutualité sociale agricole with jurisdiction in the department.

Within fifteen days of notification of the registration decision, the representative shall inform the other councils of the orders to which an application for registration of the company has been submitted of this decision, by any means that provides a date certain of its receipt.
