Section 5: Suspension in an emergency

The doctor, dental surgeon or midwife whose right to practise is suspended pursuant to article L. 4113-14 may be assisted, when he is heard by the administrative authority that imposed the suspension, by one or more persons of his choice.

When the doctor, dental surgeon or midwife suspended pursuant to article L. 4113-14 works in one or more health establishments, the administrative authority which pronounced the suspension shall immediately inform of its decision the person legally responsible for the establishment or establishments where the person concerned works and, in the case of public sector employees, the appointing authority where this is different from the person legally responsible.

Where the doctor, dental surgeon or midwife suspended in application of article L. 4113-14 is a civil servant, the hierarchical authority shall maintain his salary, residence allowance, family salary supplement and compulsory family benefits and, where he is not a civil servant, his monthly emoluments.
